Valid consent for treatment or care is essential. Without it, professionals delivering that treatment or care could be committing a criminal offence, such as assault or battery, or exposing themselves or their organisation to regulatory sanctions or compensation claims.
A valid best interests decision can replace the patient’s consent if they are unable to make the decision themselves.
